PUBLIC NOTICE 21-01

The Local Rules of Bankruptcy Procedure for the District of Connecticut were substantially revised in 2018 and have been in effect since September 4, 2018 (the “Local Rules”).  After the effective date of the Local Rules, a standing Bench/Bar Local Rules Committee was established to periodically review the Local Rules to determine if revisions to the Local Rules should be considered and implemented.

The Bench/Bar Local Rules Committee is comprised of the three Bankruptcy Judges of the United States Bankruptcy Court for the District of Connecticut (the “Bankruptcy Court”), and members of the Commercial Law and Bankruptcy Section of the Connecticut Bar Association.  In September 2020, the Bench/Bar Local Rules Committee began the process of reviewing and revising the Local Rules.  The Bench/Bar Local Rules Committee met and solicited input on revisions to the Local Rules from practitioners who appear in the Bankruptcy Court and from members of the Commercial Law and Bankruptcy Section of the Connecticut Bar Association.

The Bench/Bar Local Rules Committee recently presented proposed revisions to the Local Rules to the United States District Court for the District of Connecticut (the “District Court”).  The District Court voted to approve the proposed revisions to the Local Rules.

A 30-day public comment period for consideration of the proposed revisions to the Local Rules will commence on March 30, 2021 and end on April 30, 2021.  Although the revisions to the Local Rules in 2018 were extensive, the 2021 proposed revisions are not as extensive and appear in red.  The 2021 proposed revisions to the Local Rules are available for review at this link: 2021 Proposed Revisions to Local Rules.

In addition, you may also request a copy of the revisions to the Local Rules by sending an email to LocalRules@ctb.uscourts.gov.  This Public Notice will also be posted at the filing drop boxes located at each of the three divisional offices of the Clerk’s Office.

Comments to the proposed revisions to the Local Rules must be made in writing by sending an e-mail to LocalRules@ctb.uscourts.gov, or you may hand-deliver or mail your comments to the Clerk’s Office at the address below.

The Effective Date of the Local Rules will not be established until after the Public Comment period ends.

Comments must be received no later than 4:00 PM on Friday, April 30, 2021.
