I know I’ve talked about this time and time again. If you follow my blog, you are probably wondering why I’m going to dedicate another post to hiring the right lawyer for you. But I’m going to do it anyway, and I have good reason! No matter what lawyer you choose to hire, you need to be sure that he or she is properly qualified to help you with your case. If you face harassment from creditors or debt collectors, you do not have to take it! Finding the right lawyer to help you with this situation is an essential part of stopping harassment and suing the creditors, if you feel that this is necessary. Read on to find out how to determine the best lawyer to help you with creditor harassment.
Now, I’m not talking about one specific lawyer here. I’m talking about qualities that a lawyer should have in order to represent you successfully. Here are a few qualities that the lawyer you hire should have.
Experience
If bankruptcy is the right choice for you, you need to hire a lawyer who as taken on a lot of bankruptcy cases. If you want to proceed with stopping creditor harassment, you should find a lawyer who has handled creditors in the past, stopped harassment, and pursued justice for his or her clients. You’re not necessarily looking for a lawyer with experience in law – you’re looking for a lawyer with experience in bankruptcy and the FDCPA.
Knowledge
Knowledge and experience go hand in hand. The more experience with cases similar to yours that a lawyer has, the more knowledge he or she will have about bankruptcy laws, FDCPA regulations, creditors etc. You will need a lawyer with a lot of knowledge to come up with creative ways to defend your case.
Belief
You want a lawyer who believes in your case – one that actually wants to take it. If you meet with a lawyer and they seem hesitant or don’t believe that you have a case, they probably won’t fight very hard for you. Meet with the attorney during a free consultation and discuss your case. If he or she doesn’t seem very interested, take your case to another lawyer.
Fees
It will probably be obvious to you that you should hire a lawyer that is affordable if you are already in debt. Some lawyers are flexible with their payment methods and fees. During free consultations, ask lawyers about their fees. If they are upfront and honest, they will probably be affordable. If they dodge the question and talk in circles, they might be charging too much or have hidden fees. Beware of lawyers who do this.
Bankruptcy lawyers can protect you against creditor harassment. If you already have a good relationship with your lawyer as you go through the bankruptcy process, and you begin to get harassed by creditors, your bankruptcy lawyer should be able to take care of this for you.
