Resumption of Mediation

February 25, 2021: Notice of resumption of mediation in cases in the Foreclosure Mediation Program (“FMP”) involving non-federally backed mortgages.

Beginning March 1, 2021, the Judicial Branch will resume scheduling FMP premediations and mediations in cases that do not involve federally backed mortgages. At this time, all premediations and mediations will be held virtually, not in person. Foreclosure Mediation Standing Order Resumption of Mediations

The following Foreclosure Mediation Program standing order is effective immediately.

1.For all non-federally backed mortgage foreclosure cases pending in the Foreclosure Mediation Program as of 3/19/2020where mediation is ongoing, three additional mediation sessions may be held on or after 3/1/2021 provided that the plaintiff has filed an affidavit on form JD-CV-172 indicating that the mortgage is not subject to any moratorium on the foreclosure of federally backed mortgages. Mediation shall conclude after the third mediation session is held. Any party or the mediator may move to terminate or extend mediation.

2.Forall federally backed mortgage foreclosure cases pending in the Foreclosure Mediation Program where mediation is ongoing, three additional mediation sessions may be held on or after 7/1/2021, or the date the federal moratorium expires. Mediation shall conclude after the third mediation session is held. Any party or the mediator may move to terminate or extend mediation.

3.For all non-federally backed foreclosure cases pending in the Foreclosure Mediation Program where premediation has not been held, premediation will be scheduled on or after 3/1/2021 provided that the plaintiff has filed an affidavit on form JD-CV-172 indicating that the mortgage is not subject to any moratorium on the foreclosure of federally backed mortgages.

4.For all federally backed mortgage foreclosure cases pending in the Foreclosure Mediation Program where premediationhas not been held,premediation will be scheduled on or after 7/1/2021, or the date the federal moratorium expires.5.Premediation meetings and mediation sessions will be held remotely until further notice. The mortgagor, mortgagee, mediator, and any other necessary participant may appear byvideo conference or phone for any premediation meeting or mediation session scheduled.
